David Spence

Dr. Spence conducts research in Environmental Law, Governmental Regulation, and Public Policy, in the industry areas of Business Law and Energy.

Professor Spence has taught as a visitor at the Duke University Nicholas School of the Environment, the Vanderbilt Law School, the Cornell Law School, IMADEC University in Vienna, Austria and the Bren School of the Environment at the University of California at Santa Barbara. Among his corporate and public sector leadership experience he has served as Energy Policy Analyst for the North Carolina Alternative Energy Corporation and for the North Carolina Dept. of Administration, and as an Attorney, for the firm of Nixon, Hargrave Devans & Doyle.

Dr. Spence’s current research projects include: "The Politics of Environmental Regulation" and "The Public Choice Case for the Administrative State"

He is widely published and some representative publications are:
"A Public Choice Progressivism, Continued," Cornell Law Review; "The Shadow of the Rational Polluter," California Law Review; and "Managing Delegation Ex Ante: Using Law to Steer Administrative Agencies," Journal of Legal Studies.
